We at ProGenetics Ltd. (hereinafter: “the Company”) respect your privacy, collect and process information as it is required for the purposes detailed below, including to provide our services and products and to protect our legitimate interests, in accordance with, inter alia, the Protection of Privacy Law, 5741-1981 (“Privacy Protection Law“), the regulations thereunder, the guidelines of the Privacy Protection Authority, and the rest of the legal and regulatory provisions that apply to us.

 

This Privacy Policy (the “Privacy Policy“) is intended to explain what personal information the Company collects about you (or about others connected to you such as family members) – customers, potential customers, or suppliers, as part of the services we provide, such as application forms, consent forms, websites, applications and digital services, phone calls, correspondence, and information that may come from other third parties related to the provision of the service by us, what use we may make of it, and how you can contact us to receive additional information regarding the collected information, your privacy, and to exercise your rights.

 

This Privacy Policy is intended to present to you – as an existing customer, potential customer, supplier, website visitor, or any other person providing us with such information, how we collect personal information, by what means, for what purposes, and what rights you have regarding this information.

 

This Privacy Policy is in addition to any agreement made with you, in writing or orally, and in addition to any explanation given to you, in writing or orally;

 

The policy is formulated in the masculine form for convenience only and refers equally to every person.

 

  1. What is “Personal Information”?

 

This policy applies to “Personal Information” (or “Information” for short), which is data relating to an identified individual or an individual who can be identified with reasonable effort, directly or indirectly (for example, by means of an identifier, such as a name, ID number, online identifier, etc.). For example, a customer’s address, their phone number, and information about the provident funds they own, constitute personal information.

 

  1. What is “Particularly Sensitive Information”?

 

“Particularly Sensitive Information” is defined according to the Privacy Protection Law, and in the context of the Company, this information may include the following types of information:

 

  1. Personal information about a person’s private family life, sexual intimacy, and sexual orientation;

 

  1. Personal information relating to a person’s health status, including medical information as defined in the Patient’s Rights Law, 5756-1996;

 

  1. Personal information that is genetic information as defined in the Genetic Information Law, 5761-2000;

 

  1. Personal information about a person’s origin;

 

  1. For Company employees only – personal information that is a personality assessment conducted on behalf of a professional entity whose ordinary course of business is to express an opinion on a person’s personality, or conducted by means intended for the assessment of essential personality traits, including character traits, intellectual capacity, and functional capacity at work or studies;

 

  1. For Company employees and/or suppliers only – personal information about a person’s salary data and their financial activity;

 

  1. Types of Information Collected

 

As part of its activities, the Company collects personal information about: existing customers (including their family members), potential customers, Company suppliers, Company employees, and candidates for employment with the Company. The information is collected from a variety of sources, including the Company’s website and landing pages, forms, service center, email address, telephone, and other digital interfaces.

 

The collected information and its use vary according to the type of service or relationship with the customer. There is general information collected in most cases, such as customer contact details, alongside unique information for specific types of services and customers. There may be cases where additional or different information is collected according to the circumstances, all in accordance with the law and this policy.

 

Below is a description of the personal information collected according to the various services provided by the Company:

 

For Inquirers – full name, email, and phone; the user’s IP address;

 

For Tested Individuals – personal details of the customers (full name, gender, date of birth) ID number, phone numbers, email addresses, mailing addresses, spouse’s details, medical information, genetic information, HMO affiliation, possession of private health insurance, membership in an employee organization;

 

For Employees and Candidates – personal details of the employees, such as physical address, email address, salary data, working hours and attendance data, medical information (sick notes), data received from the organization’s cameras (face recognition), candidates’ resumes and questions related to a candidate’s personal status;

 

For Suppliers – personal details of the suppliers, phone numbers, email addresses, mailing addresses, ID number (tax identification number); financial data (invoices, bank account details);

The Company is the controller of the information database in which the information is stored;

 

  1. Purpose of Information Use

 

We use the information we collect for the following purposes:

  • For customers and potential customers – for the Company’s business activities;
  • For employees and candidates – for operational management of Company employees and their salary; for recruiting candidates
  • For suppliers – for the Company’s business activities with the suppliers;
  • Identity verification and identification.
  • Compliance with legal requirements and regulatory provisions.
  • Documentation, control, risk management, statistical analysis, process improvement, legal defense, and internal administrative needs.
  • Employee management and entry control to the Company’s offices.
  1. Information Collected as Part of Digital Activity

 

The Company operates a website and sometimes landing pages and other digital advertising tools (including on social networks and external sites). As part of this activity, information may be collected as follows:

 

The site and its owners save statistical and incidental information, such as IP addresses, search terms, referring sites, landing pages, and the like by standard means such as Google Analytics. This information does not personally identify a customer.

 

The customer is aware that the site may use cookies to store information. Cookies allow the site owner to understand who viewed which pages on the site, and how often pages are accessed and from where. Cookies allow the site owner to improve the customer’s visiting experience, by saving information regarding products and services that interested you on the site, so that focused, personalized information can be provided to you in the future.

 

Such digital information is automatically collected through cookies, pixel tags, and similar analytical tools such as SDKs. This information may be collected by us and shared with a third party, or collected directly by a third party. Its use is for a variety of purposes, as detailed in this policy, including for analyzing site activity, creating statistics, for security purposes, improving the user experience, and tailoring advertising. When submitting the testing forms, details are saved in the site’s database: full name, email address, and phone numbers. In this context, it will be clarified and emphasized that performing and purchasing the tests constitutes the customer’s consent to the storage of information about them in the site’s information database.

 

In addition, the Company reserves the right to use the information for statistical analyses, including improving the services provided on the site. The Company undertakes not to pass on any information that could personally identify a customer to any third party.

 

The site operators take strict precautions to maintain, as far as possible, the confidentiality of the information. However, in cases beyond their control and/or arising from force majeure, the site operators will not be responsible for any damage of any kind, direct or indirect, caused to the customer and/or anyone on their behalf if this information is lost or if unauthorized use is made of it, should such damage occur.

 

The site operators take technological and physical measures to protect personal information from loss, misuse, or unauthorized use. However, the site operators are not responsible for the content, security, or policy of external sites and it is recommended to check the privacy and security policy of every person who browses independently and uses the sites.

 

The Company’s website uses services that help analyze usage patterns on the site. These tools collect information such as visit frequency, viewed pages, interaction with content, and more. Examples of tools the Company uses are: Google Analytics and Facebook Ads. This information is collected by the operator of the service (for example, in the case of Google Analytics, the Google company) and does not allow personal identification of the user by the Company.   1. Sharing Information with Third Parties

 

We will transfer personal information to third parties only when necessary to achieve the purposes detailed in this policy, and we work to ensure that the sharing is relevant, proportionate, and controlled. We examine the entities that receive personal information from us and ensure that appropriate conditions and commitments for privacy and information security are met. The information is transferred according to the following criteria:

  • Compliance with the law: We will share information when we are obliged to do so according to the provisions of the law;

In accordance with the agreement with the customer for the provision of the service;

  • Organizational changes: In cases of merger, acquisition, sale or transfer of activity, or in an examination regarding such changes, we may transfer information to the transferee party or related parties. Such a move will be made while taking efforts to ensure that the information is handled in accordance with this policy and the law.
  • Technological uses: We use external tools for analysis and improvement of the user experience, subject to removal and control mechanisms available to the user.
  • Operational uses: Some of the third parties mentioned above are located outside the borders of the country, in areas where privacy protection laws may differ from those applying in Israel, including in the United States and Europe. We take customary measures to ensure the protection of the information even after its transfer abroad, including the use of appropriate contractual agreements. In addition, the Company is entitled to use statistical, aggregated, or anonymous information, which does not personally identify a person, including for purposes of analysis, improving services, business planning, or providing statistical data to external entities.

You are not obligated to provide us with personal information, and any provision of personal information is done with consent and out of free choice to use the site, join our services, or be in contact with us in any way. Your use of the site, joining a service, leaving details, or contacting our service centers constitutes consent to the Privacy Policy, including the collection, processing, and sharing of personal information as detailed therein.

 

Non-consent to the provision of personal information may prevent us from providing you with some of the services. For example: without providing identifying details, we will not be able to provide you with service as a customer; without documenting inquiries and their content, we will not be able to ensure handling of requests and maintaining an appropriate level of service; without contact details and products in which you were interested, we will not be able to send you information about existing services or relevant promotions.

  1. Applicable Law

 

This Privacy Policy shall be governed exclusively by the laws of the State of Israel. The exclusive jurisdiction for any matter relating to this policy shall be the competent courts in Tel Aviv-Yafo.
